Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MixyLook website and mobile application (together, the "Service"), operated by ESKELIA ("we", "us"), a SASU registered with the Paris Trade and Companies Register under number 898 123 492 (see our Legal notice). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MixyLook is a virtual try-on tool. You provide a photo of yourself and a garment — by uploading an image or pasting a link to a listing (for example from Vinted or Vestiaire Collective) — and our AI generates an image showing how the garment might look on you. Generated images are approximations for visualisation only. They are not photographs and do not guarantee fit, colour, size, or appearance.

2. Eligibility and accounts

You must be at least 16 years old, or the age of digital consent in your country, to use the Service. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorised use.

3. Credits, free grant, and purchases

Try-ons consume credits. New accounts receive a limited free grant of credits, redeemable once per person. Additional credits may be purchased through in-app purchases processed by the Apple App Store or Google Play, via our payments partner RevenueCat.

• Prices are shown before purchase and may include applicable taxes.
• Purchases are final. Credits are consumed as you use the Service and have no cash value, are non-transferable, and are non-refundable except where required by law or by the applicable app store's policies.
• Refund requests for app-store purchases are handled by Apple or Google under their respective terms.
• We may change prices and the credit cost of features prospectively.

4. Acceptable use

You agree not to:

• upload photographs of any person without their consent, or images of minors;
• submit unlawful, infringing, hateful, sexually explicit, or deceptive content;
• use the Service to impersonate others or to create misleading imagery;
• attempt to reverse engineer, scrape, overload, or circumvent the Service or its rate limits;
• resell or commercially exploit the Service without our written consent.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You retain ownership of the photos and inputs you submit ("Your Content"). You grant us a limited, worldwide, non-exclusive licence to host, process, and transform Your Content solely to operate and provide the Service — including sending it to the AI and infrastructure providers described in our Privacy Policy. You represent that you have the rights necessary to submit Your Content and to grant this licence.

Generated images are provided for your personal use. You are responsible for how you use them.

6. Third-party listings

Links to third-party marketplaces and the content behind them belong to those third parties. We are not affiliated with, endorsed by, or responsible for Vinted, Vestiaire Collective, or any other marketplace, nor for the accuracy or availability of their listings.

7. Intellectual property

The Service, excluding Your Content and third-party materials, is owned by ESKELIA and protected by intellectual property law. These Terms grant you no rights in our trademarks or software beyond the right to use the Service as intended.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that generated images will be accurate, that the Service will be uninterrupted or error-free, or that it will meet your requirements.

9. Limitation of liability

To the fullest extent permitted by law, ESKELIA shall not be liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required by law. Provisions that by their nature should survive termination will survive.

11. Changes

We may update these Terms. We will post the updated version here and revise the date above. Material changes will be communicated where appropriate. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by French law. Where you act as a consumer, you keep the protection of mandatory provisions of the law of your country of residence, and any dispute may be brought before the competent courts. You may also use the European Commission's online dispute resolution platform.
